Whistleblower reforms now a reality

  • The new Federal whistleblower regime has taken effect as of today, 1 July 2019.
  • The Treasury Laws Amendment (Enhancing Whistleblower Protections) Act 2019 (Cth) (Act) marks a major change in how Australian businesses are to deal with whistleblowing.
  • It is important that companies, who are yet to do so, get on the front foot to address these changes. A failure to implement proper policies and procedures that are adapted for your business could have serious consequences down the line.

Why a standard culture change program or engagement surveys are not the answer to mitigating People Risk.

Over recent months, APRA has ordered some of Australia’s largest banks, superannuation funds and insurers to conduct culture reviews.[1] This should provide a strong signal to all boards of the need to more closely examine an area that may not have received sufficient attention in the past.

The Royal Commission into Misconduct in the Banking, Superannuation and Financial Services Industry (Hayne Royal Commission) has laid the failures it has identified at the feet of poor corporate culture. Inevitably this has led to a debate about where accountability for these failed organisational cultures lies.

This is due to regulatory requirements for some boards as well as leading practice guidance, which recognise that there are performance benefits to organisations when their board is willing to engage in an open and honest appraisal of its own performance. However, where these evaluations are merely a routine or ‘tick-the-box’ exercise, the board will fail to address any performance issues faced by the board and individual directors such as dysfunctional boardroom dynamics.
